COLLECTIVE BARGAINING AGREEMENTS

As of July 1, 2021, some State employees are covered under Collective Bargaining Agreements (CBA), see the Division of Human Resource Management, Labor Relations Unit page for more information.  If you are in a job classification currently covered under a CBA, some of the terms and benefits of your employment may be different than the provisions outlined on this page. Please consult your CBA or agency's human resource for further information.

PROBATIONARY PERIOD

APPLIES ONLY TO CLASSIFIED EMPLOYEES

Probation is a set period during which an agency evaluates the skills, work habits and general suitability of a new hire or voluntary transfer who has not reached permanent status.  An employee may be dismissed for any lawful reason during his or her probationary period and has no appeal rights.

Classes at grade 19 and below serve six months of full-time equivalent probation.  Classes at grade 20 or higher serve one year of full-time equivalent probation.

REPORTS ON PERFORMANCE

A report on performance must be conducted for a probationary employee in a class at grade 19 or below at the end of the 2nd and 5th months of employment.

A report on performance must be conducted for a probationary employee in a class at grade 20 or higher at the end of the 3rd, 7th and 11th months of employment.



REINSTATEMENT/REAPPOINTMENT

An employee who is reinstated must serve a new probationary period unless it is waived in writing by the appointing authority.

A probationary employee who is reappointed must serve a new probationary period.

A employee who is reappointed to a class at a higher grade level must serve a trial period unless it is waived by the appointing authority.

An employee who is reappointed to a class at the same or lower grade level is not required to serve a probationary period.



DEMOTION

If a permanent employee is demoted, a probationary period is not required.

If a probationary employee is demoted, a new probationary period will be required.
